RULES AND REGULATIONS CONCERNING THE USE OF THE RECREATIONAL FACILITIES OF THE PROPERTY OWNERS ASSOCIATION OF ONO NORTH, INC.
GENERAL COMMUNITY RULES
In addition to those rules and regulations contained in the Declaration of Rights, Covenants, Restrictions, Affirmative Obligations and Conditions Applicable to Ono North, Phase I, (the “Declaration”), the Articles of Incorporation of the Property Owners Association of Ono North, Inc. (the “Articles”) and its By-Laws (“by-Laws”), the following rules are hereby adopted by the board of directors (the “Board of Directors”) of The Property Owners Association of Ono North, Inc. (the “Association”) in connection with the use of the recreational areas and facilities of the Association (the “Recreational facilities”)
- The recreational facilities are for the use of the members (as defined in the Articles and by-Laws of the association) and their invited guests who agree to abide by and comply with all of the rules applicable to the use of such facilities, including those set forth herein. Members are not allowed to invite as guest any person, or any member of such person’s family, who owns any real property located on Ono Island, unless such person also is a member.
- Designated walkways and paved areas shall be used at all times, and shortcuts shall be avoided in order to prevent accidents and to preserve the appearance of planted areas. No motorized vehicle, golf carts, skateboard, bike, or roller blades shall be operated on any walkway or area except upon the driveways and parking areas designated for vehicular use. If this rule is not followed, any damage to Rec Center property will be billed to the member.
- The sidewalks, driveways and parking areas must not be obstructed or used for any purpose other than ingress and egress, and for parking. Automobile parking spaces have been provided. No vehicle shall be parked in such a manner as to impede or prevent ready access to other parking areas. No parking space, driveway, or other area shall be used for the storage or parking of any boat, boat trailer, house trailer or any other type of towed vehicle or object, without prior permission from the Ono North Board. The members and their guests will obey the parking regulations posted in the private street, parking areas, and drives, and any other traffic regulations promulgated in the future for the safety, comfort, or convenience of the Members. Washing of cars, boats, and vehicles of any kind is prohibited.
- The recreational facilities are for the enjoyment of all members. Profanity, boisterous behavior, rough play is not permitted on the Rec. Center grounds.
- Glassware is not permitted on the Rec. Center grounds.
- Pets are not permitted on the Rec. Center grounds. Exceptions will be considered on a case by case situation by the Ono North Board.
- All members and guests must maintain cleanliness in all areas of the Rec. Center grounds.
- Seasonal hours may apply and will be posted on the Rec. Center grounds.
- All persons under the age of fourteen (14) must be accompanied by an adult in ALL areas of the Rec. Center grounds. Parents of all children between the ages of 14-17 years must sign a consent form allowing said children to use the Rec. Center facilities.
- No member shall be allowed to reserve or set aside the pool areas, or any portion thereof, for any purpose.
- All persons using the Rec. Center facility do so at their own risk. Members shall be responsible for the conduct of family members and guests. The association is not responsible for accident injury, loss or damage to persons or personal property within the Rec. Center grounds.
SWIMMING POOLS
- All persons using the swimming pools do so at their OWN RISK. In addition to following the minimum age provisions regarding use of the pools, Members shall be responsible for insuring that family members and guest of any age who they invite or permit to use the pool are either accompanied by adults, or, if using the pools without their supervision, that they are sufficiently capable of using all of the pool facilities without adult supervision. The association is not responsible for any accident or injury in connection with the use of the pools or for any loss or damage to personal property. Persons using the pool area agree not to hold the association liable for any action of whatever nature that occurs within the pool area.
- Persons under fourteen (14) years of age must be accompanied at all times by an adult.
- The number of persons who may be invited in any one group in the pool at any one time, in addition to the persons in the member’s family, will not exceed four (4).
- Members are responsible for the conduct of their guest at all times, and for the careful observance of all safety and sanitation precautions. Any person having an apparent or know skin disease, sore or inflamed eyes, cough, cold, nasal or ear discharge, bleeding cuts, or any communicable disease shall be excluded from the pools.
- No boisterous or rough play shall be permitted in the pools or in the pool areas. No running allowed in pool area. No diving or flipping from sides of pools into the water allowed.
- All persons are requested to cooperate in maintaining maximum cleanliness and tidiness in the swimming pool areas.
- Glassware is not to be brought into the pool areas. No food or drinks permitted in the pool. No open container allowed on or near side of pool deck.
- The pools shall be used in accordance with such rules and regulations as shall, from time to time, be promulgated by the Board of Health of Baldwin County, Alabama, and/or by the Board of Directors of the Association, which rules shall be posted by the Board of Directors. TENNIS COURTS
- All persons using the tennis courts do so at their own risk. The Association is not responsible for any accident or injury in connection with the use of the tennis courts or for any loss or damage to personal property. Persons using the tennis courts agree not to hold the Association liable for any actions of whatever nature that occur on or around the tennis courts.
- Persons under the age of fourteen (14) years of age must be accompanied at all times by an adult.
- Members are responsible for the conduct of their guest at all times, and for the careful observance of all safety and sanitation precautions at the tennis courts. The number of persons who may be invited in any group at any one time, in addition to the member’s family, will not exceed four (4). Proper tennis attire is required. Only tennis shoes may be worn on courts.
- No boisterous or rough play shall be permitted on the tennis courts or in the tennis area. All persons are requested to cooperate and maintain maximum cleanliness and tidiness in the tennis court area.
- NO bicycles, skateboards or skates shall be allowed within the tennis court playing areas.
- Use of the tennis courts shall be scheduled through the Association or the manager, when necessary, and use of the tennis courts shall be limited to one and one-half hour reservations per member. The tennis courts will be closed from 9PM to 7AM, local time, and during such other times and seasons as may be decided by the Board of Directors of the Association. Members and their guests shall be responsible for insuring that the last person to use a tennis court in the evenings shall be responsible for turning out the lights on the courts.
- The tennis courts shall be used in accordance with such rules and regulations as shall, from time to time, be promulgated by the Board of Directors of the Association, which rules shall be posted by the Board of Directors of the Association. FITNESS ROOMS
- All persons using the fitness rooms do so at their own risk. The Association is not responsible for any accident or injury in connection with the use of the fitness rooms or for any loss or damage to personal property. Persons using the fitness rooms agree not to hold the Association liable for any actions of whatever nature that occur within the fitness rooms.
- NO persons under the age of fourteen (14) shall be permitted to use the fitness rooms. NO child shall be allowed to stay in the fitness rooms while the parent is working out.
- Members are responsible for their conduct and guests at all times, and for the careful observance of all safety and sanitation precautions.
- NO boisterous or rough play shall be permitted in the fitness rooms. All persons are requested to cooperate in maintaining cleanliness and tidiness in the exercise rooms. 20. Tobacco, beverages, food or glassware (except plastic water containers) are not to be brought into the fitness rooms. The fitness rooms will be closed from 930PM to 5AM local time and during such other times as may be decided by the Board of Directors of the Association. The fitness rooms shall be used in accordance with such rules and regulations as shall from time to time be promulgated by the Board of Directors of the Association.
BASKETBALL COURTS
- All persons using the basketball courts do so at their own risk. The Association is not responsible for any accident or injury in connection with the use of the basketball courts or any loss or damage to personal property. Persons using the basketball courts agree not to hold the Association liable for any actions of whatever nature that occur on the basketball courts.
- The number of guest in any one group on the basketball courts at any one time, in addition to the persons in the member’s family, will not exceed four (4)
- NO bicycles, skateboards or skates shall be allowed on the basketball courts.
- Tobacco, beverages, food or glassware are not to be brought on the basketball courts. The basketball courts will be closed from 9 PM to 8AM, local time, and during such other times as may be decided by the Board of Directors of the Association. The basketball courts shall be used in accordance with such rules and regulations as shall from time to time be promulgated by the Board of Directors of the Association. PETS
- NO pets shall be allowed on the recreational grounds or in the clubhouse building. Exceptions will be considered on a case by case situation by the Ono North Board.
COMPLAINTS
- Complaints regarding the management, operations or activities including those in regard to the actions of members, their guest or other persons, or with respect to the recreational facilities, shall be made in writing to the Board of Directors of the Association. The Association may assign one or more persons or to a manager full responsibility for the enforcement of all or any one of these Rules and Regulations. Any complaint or dispute as to any of these Rules and Regulations or as to any application or enforcement thereof shall be made in writing to the Board of Directors setting forth the nature of the complaint and the names of all parties aggrieved and /or charged by reason of such matter. The board of Directors may in its sole discretion decide upon the action to be taken with respect to any such complaint without a hearing. In the event the Board of Directors elects to have a hearing upon such complaint, not less than five (5) day’s notice thereof shall be given in writing to each person in the complaint as aggrieved and /or charged, stating the date, time and place of such hearing. Proceeding before the Board of Directors shall be informal, without technical rules of evidence, and each party aggrieved and /or charged shall be entitled to be present in person or represented by his/her attorney, shall have the right to be heard, and shall have the right to question the person or persons making the complaint. AMENDMENT AND ENFORCEMENT
- Any consent or approval given under these rules by any person designated as manager or any person or committee designated as being responsible for the enforcement of any of these rules, and /or for the use of any common facility, shall be revocable at any time by the Board of Directors of the Association.
- These rules are subject to amendment by the Board of Directors of the association and to the promulgation of further rules by the Board of Directors and/or by the association.
- Any and all Social Memberships may be terminated at any time by the board of Directors. Prorated share of unused dues will be refunded.
- For the safety of all members and especially our staff, the staff attendant on duty has the responsibility and authority to enforce verbally all rules and regulations of the recreational center and grounds. If a member or any person threatens a staff attendant of the recreational center either physically or verbally the following steps will be taken by the staff: call to security or the Orange Beach police and/or both in judgement of the attendant, write account of the incident to the manager, and the manager will present to the Board of Directors upon receipt. At that time, the BOD will automatically impose the following: a monetary fine, a suspension from recreational center and grounds not to exceed 30 days, suspend member’s right to vote in next election and/or a combination of all three as is indicated as appropriate in the Covenants. Children not following the rules may be verbally corrected by the staff attendant. Children misbehaving is the sole responsibility of the parent. At the time of correction, the parent may choose to make sure children comply to the rules and regulations or take them home. All incidents that escalate to threaten the staff will be handled as stated above. The rules of the recreational center and grounds are made for protection of all members as well as our staff. There will be no tolerance for threatening verbal or physical behavior to staff in the duty of enforcing the rules.
